These notes relate to Benevolent Homes (Apportionment of Pension) - May 1980 to January 1993:
The last remaining benevolent home in Australia (1.1.A.320) ceased to exist from 1 January 1994. From November 1979 all married Age or invalid pension pensioners in benevolent homes and their partners are accepted, prima facie, as satisfying the requirements of subsection 33(2) and paid pension at the standard rate.

A |
From 1 January 1981 amendments to the Act brought the 'pensioner contribution' (amount payable to benevolent home) into line with the patient contribution in non-government nursing homes as prescribed in the National Health Act. This increased the 'pensioner contribution' from 66.66% to 87.5% of maximum pension, including any RA. In order to prevent any reduction in the portion of pension available to pensioners who were inmates of benevolent homes prior to 1 January 1981, a 'savings provision' enables this component to continue at the existing rate subject to eligibility under the income test. Future indexation (1.1.I.100) increases in pension will be applied to the 'pensioner contribution' until the full contribution is paid to the benevolent home. It should be noted that this will not apply in the case of a pensioner whose pocket money portion is less than the maximum rate that was applicable at 31 December 1980, i.e. one-third of the maximum rate specified in section 1064-81 plus, where applicable, one-fifth of the maximum rate of RA (1.1.M.60) until pension increases bring the pocket money portion (amount payable to pensioners) up to the maximum rate applicable at 31 December 1980. |

On 11 February 1982 the 'pensioner contribution' payable to pensioners in benevolent homes increased by $5.60 a fortnight to $135.80 a fortnight. All benevolent home pensioners (whether admitted prior to or on or after 1 January 1981) receiving RA prior to 1 February 1982 qualified for a higher rate of assistance under the provisions resulting from the more liberal income test, although in some cases the amount actually retained by the pensioner was reduced because of the increase in the pensioner contribution. Where a pensioner was admitted to a benevolent home prior to 1 January 1981, part of the pension (up to $42.80 a fortnight) plus part of any RA (up to $2.00 a fortnight) may be retained for his or her own use under the savings provision introduced by the Social Services Amendment Act 1979. This savings provision remained in force on 1 February 1982 and meant that a pensioner may receive so much of any increase in the rate of RA as brings the payment of RA to $2.00 a fortnight. Any excess entitlement over $2.00 a fortnight is paid to the benevolent home as pensioner contribution. |
